AGNTPOOL Marketplace Rules

Version 3.0 · Effective October 10, 2026

Contents

1.Scope

These Rules govern how the AGNTPOOL marketplace operates. They are part of the Terms of Use.

AGNTPOOL provides marketplace technology and workflow only. It is not a brokerage and is not a party to any referral agreement. It does not set or negotiate referral fees, and does not collect, hold, process, disburse or receive any part of them. It does not guarantee payment or resolve disputes between brokerages. Software subscriptions are separate from brokerage compensation.

If these Rules conflict with another authority, the following order controls: applicable law, your brokerage's policies, the referral agreement, then these Rules.

2.Eligibility

To post or claim, you must have:

  • an active Texas real estate license;
  • a sponsoring brokerage that has signed the Brokerage Participation and Authorization Agreement; and
  • verification by AGNTPOOL, which checks your license and sponsoring broker against Texas Real Estate Commission (TREC) records.

Posting is free. Claiming requires an active paid subscription, which AGNTPOOL may waive during a beta or promotional period.

Your access pauses automatically when TREC's public records no longer show an active license or sponsorship by a participating brokerage, or when your brokerage's license or authorization ends. AGNTPOOL relies on TREC's records as published; you remain responsible for your eligibility.

3.Brokers

The Brokerage Participation and Authorization Agreement gives your agents written authority to accept referral agreements on behalf of your brokerage. You can view every referral they post or claim. You remain responsible for supervising them. If you post or claim, you accept on behalf of your brokerage directly.

4.Posting

A post has three parts:

  • The opportunity. Prospect type (buyer, seller, tenant or landlord), property type (residential or commercial), city, price range and a short summary.
  • Your terms. The referral fee and the referral term: the period in which the prospect must sign a purchase or lease contract for the fee to apply.
  • The prospect. Full name and a phone number or email, plus optional details such as timeline, readiness stage and notes.

AGNTPOOL sets no default or limit on your terms. Follow your brokerage's policies. You may post only in the Texas markets AGNTPOOL serves.

Before your post goes live, you confirm that:

  • you accept the referral agreement on your terms, and your post complies with these Rules, your brokerage's policies and applicable law;
  • you have the prospect's permission to share their information for this referral; and
  • you agree to the Terms of Use.

Record any known contact restrictions in the prospect notes.

Describe the opportunity in objective terms only. Include a language or accessibility need only if the prospect requested it. Never describe a person by race, color, religion, national origin, sex, familial status, disability or any other protected characteristic, and never use language that suggests a preference about who lives in a neighborhood.

You may withdraw an opportunity only while it is unclaimed. Once claimed, it cannot be withdrawn; any later change requires the written agreement of both brokerages (Section 10). A withdrawn post remains in the record.

5.Visibility

Until both sides accept the referral agreement, other agents see only the opportunity and your terms, plus the timeline or readiness stage if you included one. They cannot see the prospect's name, phone number, email, exact address or notes, or your name or brokerage. AGNTPOOL does not sell placement or ranking.

6.Claiming

The first eligible agent to claim receives conditional priority, determined by AGNTPOOL's timestamp. The opportunity is held for you for the review window shown on it. Within that window, review the proposed terms, complete the acknowledgments and accept the referral agreement. If the window expires, the opportunity returns to the marketplace.

Conditional priority is not ownership, exclusivity or a right to a fee. You cannot claim your own opportunity.

Claim only if you can serve the prospect promptly and competently, in an area and transaction type you are qualified for. Declining an opportunity carries no penalty.

7.The referral agreement

Every referral is a written agreement solely between the referring brokerage and the receiving brokerage. The referring agent accepts it when posting; the receiving agent accepts it when claiming. Each acts under their brokerage's written authorization. The agreement takes effect upon the last acceptance.

The prospect's details then unlock for the receiving agent. Both agents, their brokers and authorized AGNTPOOL administrators have access to the same stored copy of the agreement.

8.After you claim

  • Contact promptly. Make a good-faith first contact within 24 hours of acceptance, using the prospect's preferred method.
  • Contact lawfully. You and your brokerage are responsible for complying with do-not-call, consent and other contact laws. A post on AGNTPOOL is not consent to be called or texted.
  • Identify yourself. State your name, your brokerage and how you received the referral.
  • Honor stop requests. If the prospect asks you to stop contacting them, stop and record it in a status update.
  • Report conflicts. As soon as you learn of a conflict, such as existing representation by another brokerage or your own, record it in a status update.
  • Keep status current. Update the status at least every 7 days until the referral closes or is released.

9.Closing and fees

Referral fees are paid by the receiving brokerage directly to the referring brokerage, as stated in the referral agreement. AGNTPOOL does not collect, hold, process, disburse or receive any part of a referral fee, and does not guarantee payment. When a referral closes, the receiving agent records the closing and the fee in AGNTPOOL and marks the fee paid. The referring agent confirms receipt, so both sides hold the same record.

10.Releasing

If you cannot continue, release the referral in AGNTPOOL and select a reason. Silence is not a release. The referral returns to the referring agent, who may repost or archive it. A repost is a new opportunity with its own referral agreement.

A release does not change the referral agreement or any fee already earned. Changes require the written agreement of both brokerages.

AGNTPOOL may reopen an opportunity if a claim lapses, a brokerage's authorization ends or a material issue arises.

11.Void referrals

AGNTPOOL may mark a referral void if its agreement was accepted with a material error, such as the wrong brokerage. The record is retained with the date and reason, and AGNTPOOL stops tracking the referral. Voiding does not determine what the brokerages owe each other.

12.Duplicates

If the same prospect appears to be posted more than once, AGNTPOOL may pause the posts and request information from each side. A duplicate flag is not a finding of wrongdoing.

AGNTPOOL decides how the marketplace handles the duplicate. Who is owed a fee is determined by the brokerages, their agreement or applicable law.

13.Confidentiality

Use prospect information and referral terms only for the referral they belong to. Do not post them publicly, share screenshots, add them to marketing lists or retain them for other purposes. Report a lost device or any suspected unauthorized access to AGNTPOOL and your brokerage immediately.

14.Prohibited conduct

  • Posting opportunities that are fake, stale, unauthorized or not your own.
  • Claiming to block others, to collect data or without intent to serve.
  • Discrimination, steering or coded language.
  • Circumventing a referral agreement, or paying or accepting a fee outside brokerage channels.
  • Sharing accounts, using bots, operating multiple accounts or scraping.
  • False status updates or altered records.
  • Harassing or pressuring prospects or other agents.

15.Enforcement

Depending on severity, AGNTPOOL may issue a reminder, correct or remove content, pause an opportunity, limit features, or suspend or close an account. AGNTPOOL may also notify your brokerage.

Fraud, discrimination, misuse of prospect data, unlicensed activity or safety threats may result in immediate suspension.

In all other cases, AGNTPOOL will state the concern and give you an opportunity to respond before acting. You may request reconsideration at support@agntpool.com.

16.Records

AGNTPOOL keeps a time-stamped record of posts, claims, agreements, prospect-detail unlocks, messages and status changes. Corrections are added alongside the original entry, never in its place. Agreements and their records cannot be deleted on request. These records supplement, and do not replace, your brokerage's own recordkeeping.

17.Changes

Material changes receive a new version and effective date. You will be asked to accept them before continuing.
